Chapter 7 Bankruptcy Representation
In a Chapter 7 bankruptcy filing, you have the opportunity to discharge certain debts in exchange for the sale or liquidation of some of your assets. If you successfully file and complete a Chapter 7 bankruptcy, many of your debts may be discharged. The goal is to give you a fresh start.
The bankruptcy laws changed in 2005, though, making it more difficult to qualify for a Chapter 7. You must now demonstrate to the bankruptcy judge that you lack the means to repay your creditors. If the court determines that you have enough resources to pay your creditors back, your only recourse will be under Chapter 13.
When you hire me to handle your bankruptcy, I will examine your assets and income and help you determine whether you will meet the means test. If you qualify for a Chapter 7, I will make certain you understand which debts, such as child support arrearages, student loans, and some tax obligations, cannot be discharged in bankruptcy. I will also make certain that any exempt assets, which may include your primary residence and vehicle, are not sold as part of your bankruptcy estate.
Chapter 13 Bankruptcy Counsel
In a Chapter 13 bankruptcy, you agree to pay your creditors in part or in full over a period of three to five years. After making all of your payments, many of your debts are discharged.
